The idea of the judicial precedent and of ‘review by the courts’ is a key element of the British frequent law upon which Indian law is predicated. The contribution of Justice V.R. Tort law in India is primarily governed by judicial precedent as in other frequent law jurisdictions, supplemented by statutes governing damages, civil process, and codifying frequent law torts. As in different Law News common law jurisdictions, a tort is breach of a non-contractual duty which has brought on damage to the plaintiff giving rise to a civil explanation for action and for which treatment is available. If a treatment does not exist, a tort has not been committed because the rationale of tort law is to offer a remedy to the person who has been wronged.
